In his activities, Mr. Schenck attempted to follow the spirit of the law, but he failed to follow its letter. I share Kaitlyn Schoen’s opinion that Schenck’s leaflet was not protected under the Constitutional because of the Espionage Act.

In fact, it is the Espionage Act that Mr. Schenck and his party should have protested against rather than the Conscription Act. Thus, the Espionage Act was the reason why Mr. Schenck’s free speech was not under protection.
