We know an officer cannot stop or arrest a person based on a “hunch”. However, in Whren v. U.S., the U.S. Supreme Court upheld a ‘”pretext arrest”. Does the Whren decision encourage law enforcement to “circumvent” the legal system? Why or why not?

The case of Whren v. the United States led to numerous debates regarding the initial reason for pullover and the arrest it led to. However, due to the evidence, the officer observed When speeding away and stopped him due to this fact. The initial pullover was not based on a “hunch,” neither was it a racially motivated check since the officer had probable cause that there was an incident. The arrest itself was based on evidence that the officer saw in Whren’s vehicle. The decision made by the Court during this case does not allow law enforcement to conduct vehicle searches during traffic stops.
