The problem of deciding which parent should be given custody of the child after divorce is marked by the common view that mothers are more reliable caregivers. Silberg and Dallam state that “patriarchal beliefs remain one of the strong influences in evaluators making recommendations that imperil children’s safety,” implying that fathers abuse more frequently than mothers.

However, the court should not give children to their mothers automatically due to the probability of the mothers’ incapability or ineligibility to provide sufficient care for the child. Moreover, there are no law-based preferences to give more custody rights to women than men, which is why both parents should be given equal opportunity to prove their capability to parent if they both desire to obtain custody.
