Unlike interviews, interrogations are conducted only with suspects placed under arrest. To conduct them, one needs to consider a person’s constitutional rights and standard procedures for the documentation of evidence. Admissions (the acknowledgment of certain facts) are not retractable and can come from any people, whereas confessions are only made by the accused individuals. The Miranda warning is the rule stating that any person should be informed that he/she can use the right to silence; the rights should be read right after the arrest and before interrogations. However, if an actual offender is not under arrest during the interview or makes a confession before listening to the warning, the rule can be ignored.
What is the difference between an Interview and an Interrogation? What must be considered when conducting them? What is the difference between an admission and a confession? What is the Miranda warning? When must a suspect be read his/her rights? And are there situations where statements can be introduced into court absent the Miranda Warnings being read?
