In the Leonard v. PepsiCo, Inc., 88 F. Supp. 2d 116, 123 (S.D.N.Y. 1999), and, 210 F.3d 88 (2d Cir. 2000), the Courts did not accept the argument that the advertisement showing the Harriet jet aircraft constituted an offer by the company to induce the public to respond to it by advertisement. It was just a gimmick.
