The rule of law plays an important role as one of the guiding principles for public managers to complete their legitimate duties. On the one hand, this rule is characterized by its positive impact on society and the possibility to reduce discrimination and biased attitudes. Public managers cannot perform arbitrary or capricious actions in relation to families or individuals without serious legal reasons.
Thus, all people are protected by the law, and the Jacks/Fogel family was not disturbed because of someone’s concerns and judgments. On the other hand, it is hard to see a real problem through the prism of justice, equality, and freedom. The girls were protected by the rule of law, but their mothers neglected other rules related to human rights or parental neglect. Public managers could not use their authority to penetrate the family and save the children legally. That is why following the rule of law led to a bad result.
