Management rights are common and legally justified practices in contract drafting. Indeed, companies, along with other parties to an employment agreement, must have officially stated rights. The separation of the competencies of the management team and the labor association is also a critical element of any contract. In this sense, the theory of rights copes with its task with dignity, leaving the company with essential areas of responsibility while allowing unions to intervene when workers’ rights are violated.

However, there are both pros and cons associated with contracting out certain services in the public sector. The main disadvantage is undoubtedly the loss of managerial control over the work done. The powers of the organization are reduced, and management rights cannot be fully realized. Nevertheless, a significant advantage that pushes the public sector towards outsourcing is the relative cheapness of this kind of labor and, consequently, the reduction of costs.

For this reason, given the fiscal constraints, an organization benefits from contracting out as it gets the service cheaper. Therefore, the public sector will likely go for it and use it as an advantage in negotiating with a union when there is an opportunity to opt for such managerial reform.
