For the equitable estoppel doctrine to be used, material facts must have been concealed, the party being estopped should have known those facts, at the time of representation, the harmed party should be unaware of the facts, and the representation of such facts must be acted upon. In other words, the following elements should be present inequitable estoppel – injury to the plaintiff, proof of misconduct, fraudulent intent, knowledge of facts, concealment or misrepresentation of facts, and inducement and reliance. Under detrimental reliance, which relies heavily on promissory estoppel, a promise must be made, the plaintiff should have relied on that promise to act, and the only way to avoid injustice is by enforcing the promise. For example, suppose a company agrees to hire an employee, and before signing a contract, the employee moves his family from a different city to a place close to the company. If the company decides not to hire the employee, the law recognizes that consideration was made. The employee relied on the promise to be employed to move his family, and thus the only way to ensure justice is by enforcing the promise.
