State A dumps its raw, unprocessed sewage into the sea, thereby killing much of marine life along its coastline and coastlines of its neighbors, States B and C. Under Article 210 Subsection 4 of United Nations Convention for Law of Sea (UNCLOS), pollution by dumping by States, acting especially through competent international organizations or diplomatic conferences, shall endeavor to establish global and regional rules, standards, and recommended practices and procedures to prevent, reduce and control such pollution. Such rules, standards, and recommended practices and procedures shall be re-examined from time to time as necessary.

Again under Subsection 5 of UNCLOS, dumping within the territorial sea and the exclusive economic zone or onto the continental shelf shall not be carried out without the express prior approval of the coastal state, which has the right to permit, regulate and control such dumping after due consideration of the matter with other States which by reason of their geographical situation may be adversely affected thereby.

Again, under the London Convention, the dumping of sewerage is actively discouraged and banned since it could be a major source of hazard for marine life and could render permanent damage to the marine environment.

The International Court of Justice (ICJ) should serve to restrain notice to Country A under the London Convention 1972 and other relevant sea protection laws. Further, it needs to be seen that Country A is inviting cause for penalty and compensatory damages by violating international ocean safety laws.

In this case, it is seen that the provisions of Annex IV of MARPOL (73-78) are also invoked. Under it, “The discharge of sewage into the sea will be prohibited, except when the ship has in operation an approved sewage treatment plant or is discharging comminuted and disinfected sewage using an approved system at a distance of more than three nautical miles from the nearest land; or is discharging sewage which is not comminuted or disinfected at a distance of more than 12 nautical miles from the nearest land.”
