At first, the majority noted an issue of standing since the entry restrictions did not apply to any of the plaintiffs of the case themselves but toward others attempting to enter the United States. However, the Court upheld that the plaintiffs have the standing to challenge the law, particularly because family members may be excluded from entry, leading to separation from relatives. This was sufficiently concrete for the Court to form a basis of Article III injury based on previous court cases that a bona fide relationship with a person seeking to enter the country can be claimed as hardship legally if entry is not permitted. The judges used rational basis review to establish this. However, the plaintiffs did not demonstrate the likelihood of success in their merits, which is based upon the Establishment Clause, since the Proclamation was premised on legitimate national security justification. The travel ban did not violate the Establishment of the Free Exercise Clause of the First Amendment.
