The educational institution for impoverished girls has Oprah Winfrey’s name because it was her idea and project. While the first element is met, Oprah’s statements cannot be classified as extreme and outrageous as they address the issue directly related to the plaintiff’s performance. Causation and qualification of emotional distress are also hard to define. Hence, the court will accept Winfrey’s move to summary judgment.

There is no need for the physical injury to claim for intentional infliction of emotional distress, as physical manifestation is not always present in cases of distress. The severity is proven by a mental health professional. Plaintiff could claim false accusation, which would need an investigation on the matter.
