In 2006, a 21-year-old girl named Christina Eilman was arrested at Midway Airport for causing a disturbance. Although she was mentally ill, a police officer took her from the airport and dropped her off in a neighborhood well known for being unsafe. Her family later pointed out that she was dressed in a way that attracted attention. She was unaware of where she was and mentally unable to appreciate the dangers surrounding her. Furthermore, she was a young white girl, and her family argued that the officer dropped her off in a predominantly black, poverty-stricken neighborhood where she stood out and could foreseeably be the victim of a crime. After being dropped off, Christina was sexually assaulted by a gang member and thrown out of a seven-story window. Her parents subsequently filed a lawsuit against the city and police officer for being negligent. How do you think the court decided?

The case of Christina Eilman is devastating. Regardless of the cause of her initial disturbance at the airport, the decision to take her from the airport and then drop her off in the unsafe neighborhood must be explained by the police officer. A lawsuit against the city and police officer is reasonable in that case.

Negligence is one of the eight main causes of action for forming a lawsuit against the city and police. Suing the police for negligence is allowed when the way their normal work is carried out is harmful or does not provide the necessary care in cases when they should have. 21-year-old Christina Eilman was mentally ill, which may have caused the initial disturbance in the airport.

Nevertheless, the officer did not address this fact and may have acted intentionally to put the vulnerable girl in a high-risk situation. The aim of police is to care and protect, but not to put people in danger. Based on Raleigh v. Performance Plumbing & Heating, 130 P.3d 1011, 1015, there are four main elements of negligence – duty, causation, breach, and damages. Hence, the police officer violates the element of duty.

The aspects of causation and damages are also clear, as exposing a mentally ill young girl to an unsafe neighborhood directly led to her being sexually assaulted and thrown out of a seven-story window. The element of a breach can also be proven because, by one of the official definitions, negligence is a failure to exercise the standard of care that a prudent person would have exercised in a similar situation.

Not much was required from the officer. He could have driven the girl home, to the local hospital, or even to the police office, where she would be safe. However, he did not, which means that the police officer is in breach. Therefore, I believe that Christina’s parents will win the case.
