How have affirmative action and ADA laws changed hiring practices?

Now, hiring policies in teaching profession have been influenced by the provisions of Equal Employment Opportunity Commission (EEOC) and Americans with Disabilities. (ADA). School management should avoid language in their job advertisement that prevents individuals in protected age groups for applying any job. Hiring advertisement that specify that those who crossed forty years need not apply or only retired people can apply for a particular job should be avoided.

It is significant to differentiate between essential and nonessential activities as a person with impairment can able to carry out the requisite affairs of the job with either or devoid of lodging. A college may refuse to recruit a person with impairment if he is unable to carry out a necessary function of the job and there is no infringement of provisions of ADA.

A school management has to observe the following while conducting an interview for a teaching position.

  • To ensure that all questions are job-associated.
  • It is wise to ask analogues queries to all applicants.
  • Narrate the job needs and inquire whether they can do them.

Courts have held that recruiters should not show preferences to relatives in school hiring process and hiring process should not involve barring of members of some clusters like blacks, women or old age people.

An educational institution should espouse the following during its hiring process to circumvent any fallout from the provisions of Americans with Disabilities Act and from Affirmative actions.

  • Employment descriptions and ads should be detailed and accurate.
  • Employment ads are intended to reach the maximum number of probable audience of interested and qualified applicants.
  • Employments ads or screening methodologies should filter out or discourage members of the safeguarded groups.
  • Techniques followed in the interview should be consistent and job-associated.
  • Education institutions hire the individual with best qualifications and should not discriminate an application on the footage of barred criteria like race, age, sex, disability or color. ( Webster 1992 )
