Concerning an individual’s identity, evidence and appearance are used by the courts to determine a person’s race, thereby choosing the treatment due to their ethnic identity. Evidence entails a person’s life, which is determined by analyzing their perceptions, social status, close associations with people of a particular race, and their rights.

For example, if individuals associate themselves with whites and enjoy a high social status, they are perceived to be white. Appearance entails physical observation of a person’s face, hair, and feet. Dark skin, curly hair, big lips, and broad nostrils are some of the traits usually taken by the court system to be proof of Negro blood.
