Constituent Power is the concept of creating a political order without being subjected to it. It is the entity of the people which seeks to create constitutional order. Preuss argues that Constituent Power dissolves once the Constitution is written. He writes, “the very meaning of constituent power is the transmutation of the creative, unorganized, and untamed power the revolution in the constituted powers of a particular political regime.” The writing of the Constitution signifies the final act of the revolution. It changes the political status of revolutionaries which is necessary to maintain legitimacy. A Constitution can only exist as long as it has support from the people whose ideas led to its creation.
