Assume you are tasked with an investigation of British Airways Flight 268. Do you think the Captain should have been charged by the FAA? Explain.

Federal Aviation Administration (FAA) should not have charged the captains of British Airways flight 268 for two reasons. Firstly, at the time of the flight, FAA regulations on this type of flight incident were fairly ambiguous. It required the pilot of an airplane that has lost an engine to land at the nearest “suitable” airport. Here, one could interpret the term “suitable” however they deem right, and the airplane pilots could claim that the Manchester airport they landed on was the nearest “suitable” one for them.

Second, Flight 268 pilots did not decide to fly with three engines on their own. They had consulted company engineers at Heathrow Airport, who had told them that it was safe to continue flying. Third, the European Union regulations allowed captains to continue flying with the remaining three if one out of four engines failed mid-flight. Therefore, the pilots neither flaunted any regulations nor acted ignorantly, and FAA should not have charged them.
